Slovenia signed the Council of Europe Convention on the counterfeiting of medical products and similar crimes involving threats to public health (CETS 211, MEDICRIME Convention) on 6 March 2019.
The Convention now counts 14 signatory countries as well as 15 countries who have ratified it.
The Convention, which entered into force in January 2016, criminalises:
- The intentional manufacturing of counterfeit/falsified medical products (i.e. medicinal products and medical devices), active substances, excipients, parts, materials and accessories;
- supplying, offering to supply and trafficking in counterfeit/falsified medical products, active substances, excipients, parts, materials and accessories;
- falsification of documents;
- unauthorised manufacturing or supplying of medicinal products and the marketing of medical devices that do not comply with conformity requirements, where such conformity is legally required.
It also lays down a framework for national and international co-operation between the competent health, police and customs authorities and the effective prosecution of crime and the protection of victims.
